On 19 June the Rhode Island’s House Of Representatives postponed voting on legislation that is expected to enforce the state’s Access to Public Records Act. From one hand the new piece of legislature would increase the fines for police departments and other public agencies that fail to comply with the prescribed time limits, while from the other hand it would facilitate the process of requesting the public records for an ordinary person, who is little versed regarding the specifics of filing a request for the public record he or she needs.

The bill was introduced by the Republican Edith Ajello. This new bill is different from the other bill that had been vetoed by the Gov. But Carcieri last year, so the sponsor of the current bill has expressed the hope that Carcieri wouldn’t be unwilling to sign it into law this time.

If approved, it will introduce the following changes:

•    Reduce the term for the response of a custodian for a public records request from 10 to 7 days
•    Increase the fine from one to five thousand dollars for violating public records law provisions
•    Extend the list of records to be considered public by adding new entries
•    Mandate that certain parts of the police records (reports) considered public be released within the 24 hours after the arrest

What is completely new about this new public records legislature, is that it would prohibit officers responsible for releasing public records to ask requester to release first the information about himself/herself, which would be truly a historical change, putting Rhode Island ahead of many other states within the terms of people’s privacy protection. Asking a requester about his details like full name, address, etc. has historically been a powerful weapon in any official’s hands to discourage citizens from asking for the information they have unconditional right to know.
